What Are Damages?

Damages are monetary compensation awarded or negotiated for harm caused by another party’s wrongful conduct. In a personal injury or wrongful death claim, damages may address financial losses, physical pain, emotional suffering, loss of companionship, and other legally recognized effects. The amount depends on the evidence, the harm, and the circumstances of the claim.

  • Wrongful death damages may address losses suffered by surviving family members.
  • Damages differ from liability, which concerns who caused the harm.

How Damages Works

A damages form lies on a desk beside stacked cash, coins, and a wooden gavel

Damages are assessed by connecting a person’s losses to the conduct that caused the harm. Evidence may include medical records, funeral expenses, employment information, witness accounts, and personal testimony. The evidence helps show the type and extent of the loss.

Related glossary terms: Economic Damages, Pain and Suffering, Punitive Damages.

Wrongful death claims may include financial support the deceased would have provided, household contributions, and the family’s loss of companionship. Economic Damages focus on financial losses, while pain, suffering, and relationship losses address nonfinancial harm. Punitive Damages serve a different purpose and may apply when the conduct calls for punishment under the law.

From the Atlanta Auto Law team

When we evaluate damages in a wrongful death claim, we organize evidence around the family’s financial and personal losses. We review records, testimony, and the circumstances of the death to separate supported losses from assumptions. Our team also considers how the claimed damages connect to the responsible party’s conduct.

Damages in Practice: A Real-World Example

A surviving spouse loses financial support and household assistance after a fatal crash. The wrongful death claim may seek damages for those losses, funeral expenses, and the spouse’s loss of companionship when supported by the available evidence.
