What Is a Notice Requirement?

A notice requirement is a legal or contractual rule that requires an injured person or representative to notify a specified party about a claim within the required process. The rule may identify who must receive notice, what information notice must contain, and how notice must be delivered. Missing a required notice can affect claim rights.

Key Takeaways About Notice Requirement

  • Notice rules may apply before a lawsuit or claim proceeds.
  • The recipient and delivery method can affect compliance.
  • Notice is not the same as filing a lawsuit.

How Notice Requirement Works

A notice requirement tells a claimant which party must receive information about an injury claim and what form that information should take. The requirement may come from a law, an insurance policy, a contract, or an agreement involving a government entity. The applicable rule can address the event, the injury, the location, and the person making the claim.

Compliance usually depends on more than sending a message. The claimant may need to use a particular delivery method and provide enough detail for the recipient to understand the event and the claimed injury. An insurance report, an incident report, and formal legal notice may serve different purposes. A notice requirement does not itself prove fault or establish the value of a claim.

From the Atlanta Auto Law team

When we review a bus accident claim, we identify every possible recipient of notice and examine the rule that may apply to each party. We compare incident records, insurance communications, and available claim documents to check whether the notice describes the event and injury clearly.

Notice Requirement in Practice: A Real-World Example

A passenger suffers an injury during a bus trip and reports the event to the driver. A notice requirement may call for separate notice to the transit operator or another responsible entity, so the passenger's report alone may not complete the required process.
