How Dram Shop Liability Works

Dram Shop Liability examines whether an alcohol provider’s conduct contributed to an injury caused by an impaired customer. The analysis focuses on what the provider knew or should have recognized, what service occurred, and how the customer’s condition affected the crash. A claim may involve an alcohol vendor and the impaired driver in the same case.

Evidence may include purchase records, surveillance video, witness accounts, employee statements, and medical or crash records. The injured person must connect the alcohol service to the harm through a clear chain of events. Proximate cause describes that connection between the provider’s conduct and the injury. The claim does not automatically succeed because a crash involved alcohol.

From the Atlanta Auto Law team

When we review a drunk driving accident claim, we examine the driver’s conduct and the alcohol provider’s possible role separately. We look for records and witness accounts that may show what the provider served, what the provider observed, and how those facts connect to the collision.

Dram Shop Liability in Practice: A Real-World Example

A driver leaves a business after being served alcohol and later causes a collision that injures another motorist. The injured motorist may examine the provider’s service practices and available records when evaluating a Dram Shop Liability claim.
